Legal stuff - an explanation!

I regularly employ Maidstone solicitors 'Stoneham Burstows' to advise and update me on the preparation of my Assured Shorthold Tenancy Agreements.

Heads of Terms include:

·       fixed term (duration) of 12 months (or thereabouts) to accord with the UKC academic year

·       tenants welcome to reside at the houses throughout the term of the tenancy to include each holiday - save where otherwise agreed and variation appended to agreement i.e. usually to accommodate works of maintenance and repair  

·       rent payable in 12 equal installments monthly in advance. The first month's rent will be payable on signing tenancy agreement and the following 11 months' rent payable by standing order to be completed after signing agreement. In my experience this has proved far easier in terms of administration than organising a sequence of cheques and/or standing orders that vary throughout the year.

·       deposit - payable on signing tenancy agreement and held under the terms of the Tenancy Deposit Scheme

·       tenants to be joint signatories to tenancy agreement i.e. each group member to sign the one agreement and thus be jointly and individually responsible to abide by all terms within it. I shall explain this to each group at viewings and suggest you may like to get independent advice from the Students Union 

·       tenants to:

·       keep the interior of property, furniture and fittings in good condition and complete (reasonable wear and tear accepted)

·       pay rates (exemptions apply for Council Tax subject to presentation of Student Certificates to Canterbury City Council) and service bills i.e. gas, electricity and telephone

·       permit landlord/agents/workmen entry at reasonable times

·       not assign or sub-let - for our mutual peace of mind!!!

·       insure own possessions

·       landlord to:

o      keep main structure of premises, water/gas supply, electrical wiring and sanitation in good condition

o      furnish

o      insure premises, furniture and fittings.
